Vaya Health Technologies Pvt. Ltd. ("Vaya", "we", "us") is committed to protecting your privacy. This policy explains what we collect, how we use it, and the rights you have.

Information we collect

We collect only what is necessary to deliver safe clinical care and operate the platform:

  • Identity & contact — name, age, gender, phone number, email, delivery address
  • Health information — height, weight, BMI, medical history, medication history, symptoms, consultation notes, and doctor's prescription records
  • Payment — billing address and transaction metadata (card details are handled only by our PCI-DSS compliant payment processor; we never see or store card numbers)
  • Technical — device identifiers, IP address, browser type, and anonymised usage analytics

How we use your information

Your information is used to:

  • Facilitate safe clinical assessment and prescribing by our licensed doctors
  • Coordinate delivery of prescribed medication via licensed pharmacy partners
  • Provide follow-up care, dose adjustments, and side-effect support
  • Communicate essential service updates (appointment reminders, safety notices)
  • Meet our legal obligations — including medical record retention and regulatory reporting

We do not sell your data to advertisers, data brokers, or any third party. Ever.

Sharing your information

We share information only with a small, named set of parties — and only what is strictly required:

  • Licensed doctors on our clinical panel, strictly to provide your care
  • Licensed pharmacy partners to fulfil valid prescriptions (name, address, prescription only — no additional health history)
  • Payment processors to handle billing securely
  • Regulatory authorities where disclosure is legally required

Health data & sensitive personal information

Your health data is classified as Sensitive Personal Data under the Information Technology (Reasonable Security Practices) Rules 2011 and the Digital Personal Data Protection Act 2023. It is:

  • Collected only with your explicit, informed consent
  • Encrypted in transit (TLS 1.3) and at rest (AES-256)
  • Access-restricted to authorised clinical and support personnel on a strict need-to-know basis
  • Never used for advertising, sold, or shared with insurers without your separate written consent

Data retention

Medical records are retained for a minimum of 3 years from your last consultation, as required under the Telemedicine Practice Guidelines 2020 and Medical Council regulations. Account information is retained only while your account is active. Upon account deletion, personal data (other than statutorily retained medical records) is deleted within 30 days. Anonymised analytics may be retained indefinitely.

Cookies & tracking

We use strictly necessary cookies for login, session management, and security. Analytics cookies are anonymised and opt-in. We do not use third-party advertising trackers or cross-site tracking pixels. Full cookie list available in your account settings.

Your rights

Under the DPDP Act 2023, you have the right to:

  • Access the information we hold about you
  • Correct or update any inaccurate data
  • Withdraw consent at any time (note: this may prevent us from continuing care)
  • Request deletion of your account and non-statutory personal data
  • Lodge a grievance with our Data Protection Officer at [email protected]
  • Escalate unresolved concerns to the Data Protection Board of India

Security

We operate a formal information security programme: encrypted storage, multi-factor authentication for staff, role-based access control, annual penetration testing, and incident response procedures aligned with ISO 27001 principles. No system is perfectly secure — in the event of a breach affecting your data, we will notify you within 72 hours and report to the relevant authorities as required.

By accessing or using Vaya's platform, you agree to the following terms. Please read them carefully before proceeding.

About Vaya

Vaya is a technology platform operated by Vaya Health Technologies Pvt. Ltd., a company incorporated in India. Vaya is not itself a pharmacy or medical practice. It facilitates telehealth consultations with independent, licensed MBBS doctors and coordinates medication fulfilment with independent, licensed pharmacy partners.

Eligibility to use

You must be:

  • At least 18 years old
  • Resident in India
  • Legally capable of entering a binding contract
  • Providing accurate, complete, and truthful information about yourself and your health

We may suspend or terminate access if information provided is found to be materially inaccurate.

Medical disclaimer

Content on the platform is for general information only and does not constitute medical advice. Only a licensed doctor who has reviewed your specific situation can provide individualised medical guidance. Submitting the eligibility quiz does not guarantee a prescription — this is always a clinical decision made by the reviewing doctor.

Your obligations

As a user, you agree to:

  • Provide accurate, complete, and up-to-date information at all times
  • Use the platform only for lawful purposes and personal care
  • Not share, resell, or redistribute any medication obtained through the platform
  • Promptly inform us of any adverse events or changes to your health
  • Respect the time and professional boundaries of our clinical team

Intellectual property

All content on the Vaya platform — including text, design, software, trademarks, and the Vaya name and logo — is owned by Vaya Health Technologies Pvt. Ltd. or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

Limitation of liability

To the maximum extent permitted by law, Vaya is not liable for indirect, incidental, or consequential loss arising from your use of the platform. Our total liability in any 12-month period is limited to the fees paid by you in that period. Nothing in these terms excludes liability for gross negligence, wilful misconduct, or anything that cannot be excluded under Indian law.

Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Before initiating legal proceedings, both parties agree to attempt resolution through direct discussion and, if needed, mediation.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated at least 14 days before they take effect, via email and an in-platform notice. Continued use of the platform after the effective date constitutes acceptance of the updated terms.

Refund Policy

refunds.

We want you to feel confident using Vaya. Here's exactly how refunds work across our consultation, medication, and membership services.

Consultation fees

Consultation fees are refundable if:

  • You cancel at least 4 hours before your scheduled appointment — 100% refund
  • The doctor is unable to conduct the consultation due to a technical issue on our side — 100% refund
  • You are found clinically ineligible for treatment during the consultation — 100% refund

No refund is available for no-shows or cancellations made within 4 hours of the scheduled appointment.

Medication orders

Medication is supplied by a licensed pharmacy partner and handled under strict cold-chain conditions. For reasons of patient safety and regulatory compliance:

  • Dispatched medication cannot be returned or resold — no refund for a successful delivery
  • Refund is issued if medication is damaged in transit or fails cold-chain verification on arrival
  • Refund is issued if the wrong medication, dose, or quantity is dispatched
  • Claims must be raised within 48 hours of delivery with photographic evidence

Membership & programme fees

Monthly Vaya membership can be cancelled at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused days within a paid month. If you were charged in error, or charged after a valid cancellation, contact [email protected] for a full refund.

How to request a refund

To request a refund, email [email protected] with:

  • Your registered email address and phone number
  • Order or appointment reference number
  • A short description of the reason for refund
  • Supporting evidence (photographs, screenshots) where applicable

We respond within 2 working days and, where approved, process the refund to your original payment method within 5–10 working days.

Prescription Policy

Vaya operates a clinical framework designed to ensure every prescription is issued responsibly, legally, and in the best interests of the patient.

Regulatory framework

Vaya operates in accordance with the Telemedicine Practice Guidelines 2020, the Drugs and Cosmetics Act 1940, the Indian Medical Council (Professional Conduct) Regulations 2002, and applicable DCGI guidance. All medications prescribed are DCGI-approved.

Who can prescribe

Prescriptions on the Vaya platform are issued exclusively by registered MBBS doctors with a valid, current registration from the Medical Council of India or the relevant State Medical Council. Credentials are verified at onboarding and reviewed annually. Vaya does not engage with any practitioner without a current, unrestricted licence to practise medicine in India.

Clinical eligibility criteria

Semaglutide is prescribed only where clinically indicated. Standard thresholds:

  • BMI ≥ 30, or BMI ≥ 27 with a weight-related comorbidity (global standard)
  • BMI ≥ 25, or BMI ≥ 23 with a comorbidity (Asian-adjusted threshold, where clinically appropriate)
  • Type 2 diabetes for glycaemic management

The final clinical decision always rests with the reviewing doctor, irrespective of what the eligibility quiz suggests.

The consultation process

Every new prescription follows a structured process: eligibility screening, secure upload of health history, synchronous video consultation with an MBBS doctor, clinical determination, and documented informed consent. No prescription is issued without a live doctor assessment — regardless of cost, convenience, or user preference.

Prescription validity & repeats

A Vaya prescription is typically valid for one month of supply, with repeats authorised only after a review consultation. Dose titration is handled via scheduled review points; unscheduled repeats are not dispensed. This is a safety-first approach consistent with good prescribing practice.

Medication safety & adverse events

Patients are expected to report any adverse events to their care coordinator promptly. Serious adverse events are reviewed by the prescribing doctor and, where required, reported to the Pharmacovigilance Programme of India (PvPI). Vaya's coordinator team is trained in first-line side-effect triage and escalates to clinical review when needed.

Off-label use

Doctors may, in certain clinical circumstances, prescribe medication outside its licensed indication (off-label use) where evidence supports benefit and the patient provides informed consent. Any off-label decision is documented in your medical record, with the rationale clearly explained before treatment begins.
